NON-REFUND POLICY

1. GENERAL POLICY STATEMENT

The Novel Tobacco Products Association (NTPA) Kenya (Registration No: SOCA-LLTPOWY) operates a strict non-refund policy for all membership fees, entrance fees, annual registration fees, educational programme fees, and any other charges or payments made to the Association.

2. MEMBERSHIP FEES – NON-REFUNDABLE

All membership categories and their associated fees are non-refundable:

2.1 Manufacturers

Entrance Fee: KES 10,250,000 (Non-refundable)
Annual Registration Fee: KES 200,000 (Non-refundable)

2.2 Importers

Entrance Fee: KES 1,800,000 (Non-refundable)
Annual Registration Fee: KES 150,000 (Non-refundable)

2.3 Distributors/Wholesalers

Entrance Fee: KES 500,000 (Non-refundable)
Annual Registration Fee: KES 100,000 (Non-refundable)

2.4 Retail Outlets (Hotels, Clubs & Bars, Traders)

Entrance Fee: KES 100,000 per branch (Non-refundable)
Annual Registration Fee: KES 50,000 per branch (Non-refundable)

2.5 Handlers (Servers)

Entrance Fee: KES 5,000 (Non-refundable)
Annual Registration Fee: KES 1,500 (Non-refundable)

3. EDUCATIONAL PROGRAMME FEES

All fees related to the “Informed Choices: Understanding Novel Tobacco Products” educational programme and any other training or certification programmes are non-refundable once payment is processed.

4. EXCEPTIONAL CIRCUMSTANCES

The Association reserves the right to consider refunds only in the following exceptional circumstances:

Duplicate payments made in error by the member
Technical errors in payment processing by the Association
Death of individual members (with proper documentation)
Legal dissolution of corporate members (with proper documentation)

5. PAYMENT PROCESSING

All payments are considered final upon receipt by the Association
Members acknowledge this non-refund policy before making any payments
Payment confirmations serve as acceptance of this policy
No partial refunds will be issued under any circumstances

6. POLICY ACKNOWLEDGMENT

By making any payment to NTPA Kenya, members explicitly acknowledge and agree to this non-refund policy. This acknowledgment is binding and cannot be disputed after payment processing.

7. DISPUTE RESOLUTION

Any disputes regarding payments or this non-refund policy shall be resolved through the internal grievance mechanisms of the Association, followed by arbitration if necessary, in accordance with Kenyan law.

9. POLICY AMENDMENTS

NTPA Kenya reserves the right to amend this non-refund policy at any time. Members will be notified of any changes through official communication channels. Amendments will not affect payments already processed.

10. GOVERNING LAW

This non-refund policy is governed by the laws of Kenya and shall be interpreted in accordance with Kenyan legal principles.

This policy is effective immediately and applies to all current and future members of the Novel Tobacco Products Association (NTPA) Kenya.
